Considerations of Custody Modifications

Approximately 90 to 95 percent of divorces are settled through negotiations outside of court, whether on their own, through their attorneys, mediation or alternative dispute resolution. Sometimes people agree to the terms of the divorce and custody decision just to conclude the process quickly, thinking they can easily change terms later if they want. However, modifying an existing order is not that simple.

If the child relies on both parents equally for emotional and financial support, you need 75 percent of the 12 factors in the best interest test in your favor to overturn the custody decision. You must also have a significant change in circumstance since the time the original custody agreement was entered or proper cause to change the custody agreement. Examples of this include:

  • An unhealthy relationship between one party and the child
  • An inability of one parent to provide the basic needs of the child
  • A parent being unemployed
  • A parent abusing alcohol or drugs
  • Domestic violence
