Division of Property and Marital Assets
Marital property includes items such as homes, vehicles and artwork, as well as non-tangible assets: lawsuits, copyrights, disability benefits or personal injury settlements. Debt distribution, including mortgages, taxes and credit cards, is also part of the property division process.
There are three stages of dividing marital assets.
- First we must inventory all assets and debts in the estate. You want an experienced attorney to help you separate marital and non-marital property.
- Next is the valuation of property and assets. When complex financial holdings such as businesses, stock options or sophisticated retirement plans are involved, your attorney must understand business law and other financial matters. We may use forensic accountants, appraisers and investigators to be sure we have found all assets and accurately valued them.
- Finally, the court distributes the marital property. Michigan is an equitable distribution state, but that does not always mean property will be divided 50-50. Issues from the divorce factor into the equation.
